Terms and Conditions – Lincoln Place Home Build Guarantee Promotion

1. Eligibility: a. This promotion (“Promotion”) is open to individuals who have signed a contract of sale with Lincoln Place Pty Ltd (“Company”) for the purchase of a new home (“Home”) in the Lincoln Place development. b. Participants must fulfil all requirements outlined in this Agreement to be eligible for the promotion.
2. Build Guarantee: a. Lincoln Place Pty Ltd guarantees that the Participant’s new home will be ready for occupancy within 20 weeks of signing the contract of sale (“Guarantee Period”), subject to availability and specific eligibility criteria. b. This Guarantee is applicable only to specific homes as designated by Lincoln Place Pty Ltd and shall not exceed a maximum period of an additional 20 weeks.
3. Exclusions: a. The Christmas shut-down period is excluded from the Guarantee Period. b. Delays caused by force majeure events or acts of nature, including but not limited to natural disasters, extreme weather conditions, or governmental regulations, are excluded from the Guarantee Period. In such cases, the Guarantee Period will be extended by the duration of the delay caused by these events.
4. Build Time Compensation: a. If Lincoln Place Pty Ltd fails to meet the Guaranteed Period and the Participant’s home is not ready for occupancy within the Guarantee Period (excluding exclusions outlined in section 3), the Participant will be entitled to receive compensation. b. Compensation will be provided to the Participant in the form of one week of free rent for every week that the Company is late in completing the construction of the Participant’s home, up to the maximum number of weeks as defined in section 2b.
5. Qualification and Redemption: a. To qualify for compensation under this promotion, the Participant must provide written notice to Lincoln Place Pty Ltd of the delay in the completion of their home within 7 days of the expiration of the Guarantee Period. b. Compensation will be provided to the Participant in the form of a credit towards their rent payments, to be applied for each eligible week of delay beyond the Guarantee Period.
6. Modification and Termination: a. Lincoln Place Pty Ltd reserves the right to modify or terminate this promotion at any time without prior notice. b. Any disputes regarding eligibility or compensation under this promotion shall be resolved at the sole discretion of Lincoln Place Pty Ltd.
7. Limitation of Liability: a. Lincoln Place Pty Ltd shall not be liable for any loss or damages incurred by the Participant as a result of delays in the completion of their home, except as provided for under this promotion. b. Participants agree to release and hold Lincoln Place Pty Ltd, its affiliates, employees, agents, and contractors harmless from any claims, actions, or liabilities arising from their participation in this Promotion.
8. Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of the State of Victoria, Australia.
9. Modification, Termination, and Discretion: a. Lincoln Place Pty Ltd reserves the right to modify, suspend, or terminate this promotion at any time without prior notice. b. Any disputes regarding eligibility or compensation under this promotion shall be resolved at the sole discretion of Lincoln Place Pty Ltd, and the Company reserves the right to make decisions regarding eligibility and compensation in its sole discretion. c. Lincoln Place Pty Ltd retains the right to end or extend this promotion at any time, without prior notice, at the Company’s discretion.
